1. Introduction & Acceptance

These Terms & Conditions (“Terms”) constitute a legally binding agreement between Beyond Bookingnear Holidays Private Limited , operating under the brand name TopTravelDMC (“Company,” “We,” “Our”), and you (“Partner,” “You,” “Your”), governing your access to and use of our B2B travel portal, booking services, APIs, and all related offerings.

By registering as a partner, creating an account, or using our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must discontinue use of our platform immediately.

2. Eligibility & Partner Onboarding

• Only legally registered travel agencies, tour operators, consolidators, and DMCs are eligible to partner. You agree to submit accurate KYC documentation, including business registration, GST/VAT, and authorized signatory details.

• We reserve the right to approve, deny, or revoke partner access without assigning reasons, especially in cases of incomplete documentation, risk flags, or non-compliance.

• Partners must keep business details updated. Any change in ownership, legal status, or key contacts must be promptly communicated.

3. Scope of Services

TopTravelDMC acts as a facilitator and aggregator of travel services, including:

• Real-time access to hotels, flights, transfers, and activities at B2B rates

• Domestic and international package bookings (FIT & group)

• Visa facilitation, insurance, and related ancillary services

TopTravelDMC does not own or operate airlines, hotels, or ground services and therefore cannot guarantee performance beyond what suppliers commit.

4. Partner Obligations

Partners agree to:

• Provide accurate customer data (names, travel dates, passports) at the time of booking.

• Use the platform only for authorized business purposes and not for resale to unauthorized third parties.

• Maintain the confidentiality of login credentials; partners are fully responsible for all activity under their account.

• Communicate relevant supplier terms (check-in rules, cancellation penalties, visa requirements) to their end customers.

• Avoid misuse, fraudulent bookings, chargebacks, or abuse of promotional offers.

5. Pricing & Payment Terms

• Rates are subject to change based on supplier inventory, exchange rates, and seasonal fluctuations. Prices are valid only at the time of booking.

• Payments must be made via bank transfer, UPI, authorized payment gateways, or approved credit lines.

• If credit is extended, settlements must be made within the agreed period. Delays may attract interest, late fees, or account suspension.

• Applicable GST/VAT and other statutory levies will be charged as per prevailing laws.

6. Booking, Confirmation & Amendments

• Bookings are confirmed only upon receipt of full payment or credit approval.

• Amendments are subject to supplier availability and may incur additional costs.

• TopTravelDMC is not liable for any errors resulting from partner-provided data (e.g., incorrect passenger name or dates).

7. Cancellation, Refund & No-Show Policy

• Cancellations are subject to the supplier’s terms (airlines, hotels, DMCs).

• Refunds will be processed after deduction of applicable cancellation charges and service fees.

• Refund timelines typically take 7–15 working days, depending on supplier processing.

• No-shows are treated as 100% cancellation unless specified otherwise.

8. Limitation of Liability

• TopTravelDMC shall not be liable for service disruptions, delays, force majeure events (natural disasters, strikes, pandemics), or actions beyond our reasonable control.

• Our maximum liability is limited to the amount paid for the disputed booking, and no claims for consequential losses (loss of profit, goodwill, or business interruption) will be entertained.

9. Intellectual Property

All software, portal interfaces, logos, trademarks, and content remain the exclusive property of Beyond Bookingnear Holidays Private Limited.
Partners are granted a limited, revocable license to use the platform strictly for bookings. Any unauthorized copying, redistribution, or white-labeling without prior written approval is prohibited.

10. Confidentiality

All rates, commission structures, and commercial terms shared are confidential and must not be disclosed to third parties.
Any breach of confidentiality may result in account termination and legal action, including recovery of damages.

11. Termination of Access

We reserve the right to suspend or permanently terminate access in cases of:

• Breach of these Terms

• Fraudulent or suspicious transactions

• Repeated payment defaults

• Regulatory or legal directives requiring termination

Termination does not waive our right to recover pending dues or damages.

12. Privacy & Data Protection

Your use of the platform is subject to our Privacy Policy, which explains how we collect, process, and safeguard data in compliance with Indian IT Act 2000, GDPR, and other applicable regulations.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India, and any disputes shall fall under the exclusive jurisdiction of the competent courts in Lucknow, Uttar Pradesh, India.

14. Modification of Terms

We reserve the right to update or modify these Terms at any time.
Significant changes will be notified via email or platform alerts, and continued use of the platform constitutes acceptance of the updated Terms.
